{"id":4017,"date":"2026-05-22T09:30:00","date_gmt":"2026-05-22T16:30:00","guid":{"rendered":"http:\/\/eaglesbluffhoa.org\/clone\/?p=4017"},"modified":"2026-05-23T10:54:26","modified_gmt":"2026-05-23T17:54:26","slug":"signs-within-the-community","status":"publish","type":"post","link":"https:\/\/eaglesbluffhoa.org\/clone\/2026\/05\/signs-within-the-community\/","title":{"rendered":"Signs Within the Community"},"content":{"rendered":"\n<h3 class=\"wp-block-heading has-text-align-left\">HOA and Political Signs<\/h3>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Recently, a complaint was brought to the attention of the Board of Directors regarding the display of signs within the community that were characterized as \u201cpolitical.\u201d This raised the question of whether our governing documents restrict the display of such signs.<\/p>\n\n\n\n<h3 class=\"wp-block-heading has-text-align-left\">The Short Answer<\/h3>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Yes\u2014but the longer answer is more nuanced. It involves Arizona state law, considerations of free expression, and the Association\u2019s governing documents.  While the First Amendment protects free speech from government restriction, it generally does not apply to private homeowners\u2019 associations.  However, state law provides specific protections regarding political signage.  These are explained in greater detail below.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\"><strong>The Board\u2019s Position<\/strong><\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">After review, the Board acting as a committee of the whole on this enforcement matter, determined that, notwithstanding Arizona Revised Statute (A.R.S.) \u00a733-1808, the signs in question do not meet the legal definition of a \u201cpolitical sign\u201d as outlined in subsection N(4) of the statute.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Accordingly, the Association retains the authority to regulate or restrict such signage under Section 9.06 of the CC&amp;Rs, adopted in July 1993.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">The signs at issue were of modest in size, subdued in appearance, and placed on private property (e.g., on side yard gates or near front doors), several feet from the street. They were not obtrusive in placement, nor do they contain inherently offensive content. Perceptions of offense are subjective and may vary by individual.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">The Board has decided that no further action would be taken.<\/p>\n\n\n\n<h3 class=\"wp-block-heading has-text-align-left\">The Long Answer<\/h3>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\"><strong>Political Signs Under Arizona Law (<a href=\"https:\/\/www.azleg.gov\/ars\/33\/01808.htm\" target=\"_blank\" rel=\"noreferrer noopener\">A.R.S. \u00a733-1808<\/a>)<\/strong><\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Arizona law limits the extent to which homeowners\u2019 associations may regulate political signs.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\"><strong>Definition&nbsp;As Specifically Relating to Political Signs<\/strong>:<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">C. Notwithstanding any provision in the community documents, an association shall not prohibit the indoor or outdoor display of a political sign by an association member on that member&#8217;s property, except that an association may prohibit the display of political signs as follows:<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">(1) Earlier than seventy-one days before the day of a primary election.<br>(2) Later than fifteen days after the day of the general election.<br>(3) For a sign for a candidate in a primary election who does not advance to the general election, later than fifteen days after the primary election.<\/p>\n\n\n\n<ol class=\"wp-block-list\"><\/ol>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\"><strong><span style=\"text-decoration: underline;\">For the purposes of this section of (A.R.S.) \u00a733-1808<\/span> :<\/strong><br><strong>N<\/strong>(<strong>4).<\/strong> <\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">A <strong>&#8220;Political sign&#8221;<\/strong> means a sign or flag that attempts to influence the outcome of an election, including supporting or opposing the recall of a public officer or supporting or opposing the circulation of a petition for a ballot measure, question or proposition or the recall of a public officer.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"has-medium-font-size\"><span style=\"text-decoration: underline;\"><strong>Key Provisions:<\/strong><\/span><br>Associations may not prohibit political signs on a member\u2019s property, subject to certain limitations.&nbsp; Signs may be restricted if displayed:<\/li>\n<\/ul>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">(1) Earlier than seventy-one days before the day of a primary election.<br>(2) Later than fifteen days after the day of the general election.<br>(3) For a sign for a candidate in a primary election who does not advance to the general election, later than fifteen days after the primary election.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"has-medium-font-size\"><strong><span style=\"text-decoration: underline;\">Additional Guidelines:<\/span><\/strong>\n<ul class=\"wp-block-list\">\n<li class=\"has-medium-font-size\">HOAs may limit the total size of political signs to 9 square feet (unless local ordinances allow more [OV does not]).<\/li>\n\n\n\n<li class=\"has-medium-font-size\">Associations may regulate placement for safety and community standards.<\/li>\n\n\n\n<li class=\"has-medium-font-size\">HOAs cannot require signs to be professionally produced.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading has-text-align-left\">Eagles Bluff CC&amp;Rs (Section 9.06 \u2013 Signs)<\/h3>\n\n\n\n<p class=\"has-text-align-left has-medium-font-size wp-block-paragraph\"><strong>\u201c<\/strong>No signs of any kind shall be displayed which are visible from neighboring property without prior approval of the Board or the Architectural Control Committee, except:<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">A. Signs required by legal proceedings; and<br>B. Signs used by the Developer or Declarant.<strong>\u201d<\/strong><\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\"><\/p>\n\n\n\n<h3 class=\"wp-block-heading has-text-align-left\">Practical Guidelines for Residents<\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"has-medium-font-size\"><strong>When Can Political Signs Be Displayed?<\/strong>\n<ul class=\"wp-block-list\">\n<li class=\"has-medium-font-size\"><strong><span style=\"text-decoration: underline;\">Primary Election (July 21, 2026)<\/span>:<\/strong>\n<ul class=\"wp-block-list\">\n<li class=\"has-medium-font-size\">May 11, 2026 &#8211; Earliest display date<\/li>\n\n\n\n<li class=\"has-medium-font-size\">August 5, 2026 &#8211; Remove signs for unsuccessful primary candidates.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>General Election (November 3, 2026):<\/strong>\n<ul class=\"wp-block-list\">\n<li>November 18, 2026 &#8211; Remove all political signs.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"has-medium-font-size\">&nbsp;<span style=\"text-decoration: underline;\"><strong>Size and Quantity<\/strong><\/span>\n<ul class=\"wp-block-list\">\n<li class=\"has-medium-font-size\">The total combined area of all signs may not exceed nine (9) square feet.<\/li>\n\n\n\n<li class=\"has-medium-font-size\">No specific limit has been set on the number of signs, provided size limits are respected.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\"><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"has-medium-font-size\"><strong><span style=\"text-decoration: underline;\">Placement Rules<\/span><\/strong><br>Residents may place signs only within the boundaries of their property, subject to the following restrictions:<br>\n<ul class=\"wp-block-list\">\n<li class=\"has-medium-font-size\">Signs may not be placed on HOA common areas or along property lines adjoining common areas without approval.<\/li>\n\n\n\n<li class=\"has-medium-font-size\">Signs may not cross or encroach upon neighboring property lines.<\/li>\n\n\n\n<li class=\"has-medium-font-size\">Signs may not obstruct pedestrian or vehicular traffic.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n","protected":false},"excerpt":{"rendered":"<p>HOA and Political Signs Recently, a complaint was brought to the attention of the Board of Directors regarding the display of signs within the community that were characterized as \u201cpolitical.\u201d This raised the question of whether our governing documents restrict the display of such signs.
